1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Notify Nepal ("Company," "we," "us," or "our") governing your access to and use of the Notify Nepal website, services, and applications (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 16 years of age to use our Service. By using the Service, you represent and warrant that you meet the eligibility requirement. If you are using the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

3.1 Account Creation

7. Disclaimers and Limitations of Liability

7.1 Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that the service is free of viruses or other harmful components.

7.2 Limitation of Liability

To the maximum extent permitted by law, notify nepal and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims exceed NPR 1,000.

8. Indemnification

You agree to defend, indemnify, and hold harmless Notify Nepal and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If such negotiations are unsuccessful, the dispute shall be submitted to the exclusive jurisdiction of the courts in Kathmandu, Nepal.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may discontinue using the Service or delete your account through the account settings.
